1. ACCEPTANCE OF TERMS

By accessing or using FreeGo POS, FreeGo QR Ordering, FreeGo AI services, or any related software, applications, or services (collectively, the “Services”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you must not use the Services.

2. DEFINITIONS

“FreeGo” refers to FreeGo POS and its related services and systems.

“Merchant” refers to any business, owner, or entity using FreeGo Services.

“User” refers to any end customer interacting with the system (e.g. QR ordering customers).

“Services” refers to all FreeGo software, including POS, QR ordering, AI features, cloud services, and integrations.

“AI Services” refers to any voice, chat, translation, or automated recommendation features.

3. ELIGIBILITY

You must be at least 18 years old or a legally registered business entity to use FreeGo Services.

4. MERCHANT ACCOUNT

Merchants are responsible for maintaining account security, including login credentials and system access.

FreeGo is not responsible for any unauthorized access due to merchant negligence.

5. LICENSE GRANT

FreeGo grants you a limited, non-exclusive, non-transferable license to use the Services.

Unless explicitly stated, this license does not grant ownership of the software.

All intellectual property remains the property of FreeGo.

6. FREEGO POS (PERPETUAL LICENSE)

Certain FreeGo POS products may be sold as a one-time purchase with perpetual usage rights.

However, perpetual license refers only to the core POS system and does not guarantee free access to future features, add-ons, AI services, or cloud-based services.

7. QR ORDERING SERVICES

FreeGo provides QR ordering functionality that allows customers to place orders digitally.

Merchants acknowledge that:

Orders are submitted digitally and may be subject to errors due to user input or network conditions

Merchants are responsible for verifying all orders before preparation

FreeGo is not responsible for customer disputes arising from incorrect orders

Service fees or transaction fees may apply and may be updated from time to time.

8. AI SERVICES

FreeGo may provide AI-powered features including but not limited to:

Voice ordering

Chat-based ordering

Translation services

Menu suggestions

AI results may be inaccurate, delayed, or misinterpreted due to system limitations.

Merchants are solely responsible for verifying all AI-generated orders before processing.

FreeGo shall not be liable for any losses caused by AI output errors.

9. CLOUD SERVICES

FreeGo may provide cloud storage and synchronization services.

While FreeGo performs regular backups, merchants are encouraged to maintain their own data backups.

FreeGo does not guarantee uninterrupted or error-free cloud availability.

10. FEES & PAYMENTS

Fees for Services may include:

Software purchase fees

Subscription fees

QR ordering service fees

AI service fees

Credit top-ups (minimum RM100 where applicable)

All fees are non-refundable unless required by law.

FreeGo reserves the right to update pricing with prior notice.

11. ORDER SERVICE FEES

Certain transactions processed through FreeGo (such as QR orders) may be subject to per-order service fees.

Pricing may be updated from time to time and will be published on official FreeGo platforms.

12. MERCHANT RESPONSIBILITIES

Merchants agree to:

Provide accurate product and pricing information

Ensure lawful business operations

Handle customer disputes professionally

Maintain device compatibility and internet connectivity

13. CUSTOMER DATA

Merchants retain ownership of their customer and business data.

FreeGo does not sell merchant data to third parties.

14. DATA STORAGE & BACKUP

FreeGo may store operational data for service functionality.

Upon account termination, data may be deleted after a retention period.

Merchants are responsible for exporting important data.

15. THIRD-PARTY SERVICES

FreeGo may integrate with third-party services such as payment gateways, hardware providers, or government systems.

FreeGo is not responsible for failures or issues caused by third-party providers.

16. SERVICE AVAILABILITY

FreeGo aims to provide continuous service but does not guarantee uninterrupted operation.

Maintenance, updates, or external factors may cause temporary downtime.

17. SUSPENSION

FreeGo may suspend or terminate access if:

Terms are violated

Fraudulent activity is detected

System abuse occurs

Legal compliance is required

18. TERMINATION

Upon termination:

Access to Services will be disabled

Data may be deleted after retention period

No refunds will be issued unless required by law

19. INTELLECTUAL PROPERTY

All intellectual property rights, including software, branding, and system design, remain the exclusive property of FreeGo.

20. ACCEPTABLE USE

Users must not:

Reverse engineer the system

Attempt unauthorized access

Use the system for illegal activities

Disrupt system performance

Copy or resell the software without permission

21. WARRANTY DISCLAIMER

Services are provided “as is” and “as available.”

FreeGo does not guarantee that Services will be error-free, uninterrupted, or fully accurate.

22. LIMITATION OF LIABILITY

To the maximum extent permitted by law, FreeGo shall not be liable for:

Loss of revenue

Business interruption

Data loss

Indirect or consequential damages

Maximum liability shall not exceed the amount paid by the Merchant in the past 6 months.

23. INDEMNIFICATION

Merchants agree to indemnify FreeGo against any claims, damages, or losses arising from misuse of the Services or violation of these Terms.

24. GOVERNING LAW

These Terms shall be governed by the laws of Malaysia.

Any disputes shall be subject to the jurisdiction of Malaysian courts.

25. CHANGES TO TERMS

FreeGo reserves the right to update or modify these Terms at any time.

Continued use of the Services constitutes acceptance of updated Terms.
